Terms & Conditions
Terms and Conditions with Customer Information
Version: 16 October 2026 · English translation for convenience; the German AGB prevail in case of discrepancies.
1. Scope and contracting party
1.1 These Terms and Conditions (“Terms”) apply to all contracts that a consumer or business customer (“customer”) concludes via the online shop www.societydenobodies.com with
Society De Nobodies, owner: Max Zöll, Wachendorfer Weg 1, 53902 Bad Münstereifel, Germany
Phone: +49 1514 4929349 · Email: support@societydenobodies.com · VAT ID: DE333082127
(“SDN”, “we”, “us”) regarding the goods presented there.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB). A business customer is a natural or legal person or a partnership with legal capacity acting in the exercise of its trade, business or profession (Section 14 BGB).
1.3 Deviating terms of the customer do not become part of the contract unless we expressly agree to them.
2. Conclusion of contract
2.1 The presentation of goods in the online shop is not a legally binding offer but an invitation to place an order.
2.2 The customer can add goods to the cart and start the ordering process via “Checkout”. During checkout the customer enters their details, chooses shipping and payment and reaches a summary page where all details can be checked and corrected using the browser's back function or the editing functions of the checkout. By clicking the final button (“Pay now”/“Buy now” or equivalent wording) the customer submits a binding offer to purchase the goods in the cart.
2.3 We may accept the customer's offer within five days by (a) sending an order confirmation in text form (email), (b) delivering the goods, or (c) requesting payment or collecting the payment amount after the order was placed – whichever occurs first. Where the payment amount is collected immediately at the end of checkout (e.g. credit card, PayPal, Apple Pay, Google Pay, Shop Pay), the contract is concluded upon collection. The automatic acknowledgement of receipt merely documents that your order has reached us.
2.4 We store the contract text (order, Terms, withdrawal policy) and send it to the customer by email with the order confirmation. Customers with an account can additionally view their orders in the account. The current Terms are available at any time at www.societydenobodies.com/pages/terms-condition.
2.5 The contract languages are German and English.
3. Prices and shipping costs
3.1 All prices are final prices in euros and include the statutory German VAT.
3.2 Shipping costs are charged in addition and are shown during checkout before the order is placed. An overview can be found under Shipping.
3.3 For deliveries to countries outside the European Union, customs duties, taxes and fees may be incurred which are not included in the purchase price and must be paid by the customer to the competent authorities or the carrier. Their amount depends on the destination country and is not known to us.
3.4 Price reductions are displayed together with the lowest price applied during the 30 days before the reduction (Section 11 German Price Indication Ordinance, PAngV).
4. Payment
4.1 The available payment methods are shown during checkout. Currently we offer in particular credit card (Visa, Mastercard, American Express, Maestro, UnionPay), PayPal, Apple Pay, Google Pay, Shop Pay, Klarna, Bancontact, EPS and MobilePay. Payments are processed via Shopify Payments or the respective payment service provider.
4.2 For credit card, PayPal, Apple Pay, Google Pay, Shop Pay and comparable services the payment amount is due and collected upon completion of checkout. For Klarna, the terms of Klarna Bank AB shown during checkout apply in addition.
4.3 The customer may only set off claims that are undisputed or have been finally established by a court.
5. Delivery, delivery times and availability
5.1 We deliver to the delivery address provided by the customer in the countries selectable during checkout. Deliveries to EU member states other than Germany are temporarily suspended; see EU Shipping.
5.2 Unless stated otherwise on the product page, the following delivery times apply from conclusion of the contract (for prepayment: from receipt of payment): Germany 2–5 working days; rest of Europe 5–10 working days; rest of the world 7–20 working days. Working days are Monday to Friday excluding public holidays in North Rhine-Westphalia, Germany.
5.3 Goods marked “Pre-Order” or “Made-to-Order” are produced after the order is received. The expected production and delivery time is stated on the respective product page and runs from conclusion of the contract. We will inform the customer without delay about any delays. The statutory right of withdrawal also applies to these goods unless they were personalised to the customer's individual specifications.
5.4 If delivery of an ordered item is permanently impossible for reasons beyond our control, we will inform the customer without delay and refund any payments already made without delay.
5.5 For consumers, the risk of accidental loss or deterioration of the goods passes only upon handover of the goods to the consumer or a person designated by them. For business customers, the risk passes upon handover to the carrier.
5.6 Transport damage: if goods are delivered with obvious transport damage, we ask the customer to report this to the carrier immediately if possible and to inform us. Failing to do so has no effect on the statutory warranty rights but helps us to assert our own claims against the carrier.
6. Retention of title
The delivered goods remain our property until paid in full.
7. Right of withdrawal
Consumers have a statutory right of withdrawal. Details, in particular conditions, deadlines, consequences and the model withdrawal form, can be found in our Withdrawal Policy. Withdrawal can also be declared via the withdrawal function at www.societydenobodies.com/pages/widerruf (“Withdraw from contract”).
8. Warranty (liability for defects)
8.1 The statutory warranty rights apply. For consumers, the limitation period for claims for defects in new goods is two years from delivery.
8.2 If the goods are defective, the customer may, at their choice, demand subsequent performance (repair or delivery of a defect-free item). We bear the expenses necessary for subsequent performance, in particular transport, travel, labour and material costs. We ask the customer to contact us before returning defective goods so that we can provide a return label; there is no obligation to do so.
8.3 For business customers, the limitation period for claims for defects is one year from delivery; the statutory inspection and notification duties (Section 377 German Commercial Code, HGB) remain unaffected. This does not apply to claims for damages under Section 9.
8.4 Manufacturer guarantees exist in addition to the statutory warranty rights only if expressly granted.
9. Liability
9.1 We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, for fraudulent concealment of a defect, where a guarantee has been assumed, and under the German Product Liability Act.
9.2 In the event of a slightly negligent breach of a material contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance the customer regularly relies), our liability is limited to the foreseeable damage typical for this type of contract.
9.3 Otherwise, liability for damage caused by slight negligence is excluded.
9.4 The above limitations also apply in favour of our legal representatives and vicarious agents.
10. Customer account and membership
10.1 Creating a customer account is voluntary and free of charge; orders can also be placed as a guest. The customer must keep their login details secret and inform us immediately of any misuse. Registration details must be complete and correct.
10.2 Within our membership programme (“Members”), customers may collect points (“XP”) for orders, which can lead to benefits such as discounts or early access to sales. Points and benefits have no cash value, are not transferable and are not paid out. If an order is withdrawn or reversed, the points credited for it lapse. We may change or discontinue the programme with four weeks' notice; benefits already acquired for ongoing orders remain unaffected.
10.3 The customer may terminate the account at any time without notice by email to support@societydenobodies.com. We may terminate the account with 14 days' notice; the right to extraordinary termination for good cause remains unaffected.
11. Vouchers and gift cards
11.1 Promotional vouchers that we issue free of charge as part of promotions can only be redeemed within the stated period, once, and subject to the conditions communicated. They are not paid out and do not bear interest. If the value of a promotional voucher is insufficient, the difference can be paid with the payment methods offered. In the event of withdrawal, the value of a promotional voucher is not refunded.
11.2 Purchased gift cards can be redeemed for all goods in the online shop and expire three years after the end of the year of purchase. Remaining credit is retained until expiry. No cash payout; statutory rights in the event of withdrawal from the gift card purchase remain unaffected.
12. Data protection
Information on the processing of personal data can be found in our Privacy Policy.
13. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG). We have not subscribed to any code of conduct.
14. Applicable law, jurisdiction
14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
14.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office. For consumers the statutory places of jurisdiction apply.
15. Final provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
